Immigration (IND)
A letter from the IND (immigration service)?
Read a letter from the IND straight away. The deadline for an objection against the IND is shorter than for many other authorities: 4 weeks, not the general 6 weeks.
What to know
Decision (beschikking)
The decision on your application. If you disagree, you can object. How and where is stated in the decision.
Objection or appeal: 4 weeks
Immigration Act 2000, art. 69. In some asylum cases the appeal period is 1 week. Always follow the deadline in your letter.
Incomplete objection: 2 weeks
If documents are missing, send them within 2 weeks.
Need help?
You can ask a lawyer or legal aid, for example through the Juridisch Loket.
Explain my letter
Take a photo of your letter. BriefKlaar tells you in your own language what it says, what to do and by when, and drafts a reply in Dutch.
Frequently asked questions
Is the objection period really 4 weeks?
Yes, for the IND it is 4 weeks (Vreemdelingenwet 2000, art. 69). The general 6 weeks of the General Administrative Law Act do not apply. Follow the deadline in your letter.
My application was approved but the start date is wrong.
First collect your residence document at the IND desk. Then you can object, within 4 weeks of the date you received it.
Can BriefKlaar write my objection?
BriefKlaar drafts a letter in Dutch that you check and send yourself. In IND cases a lot depends on your own situation; if in doubt ask a lawyer or the Juridisch Loket.
